These Terms and Conditions (“Terms”) govern your access to and use of our website https://5starsec.com (the “Site”), along with any related services, software, tools, or support provided by us (collectively, the “Services”).

By accessing or using our Site, you agree to be bound by these Terms. If you do not agree, do not use our Services.

2. Eligibility

To use our Services, you must be at least 18 years old or the age of legal majority in your jurisdiction. By using the Site, you represent and warrant that you meet these requirements.

5 Star Sec provides cybersecurity solutions including but not limited to:

Threat monitoring and detection
Network security audits
Penetration testing
Incident response planning
Digital forensics
Cybersecurity consulting
Cloud and infrastructure hardening

All services are subject to the terms of a formal agreement or service-level agreement (SLA) between you and 5 Star Sec.

4. Acceptable Use

You agree not to:

Use our platform for illegal activities, including unauthorized access or hacking
Attempt to reverse engineer, disassemble, or tamper with our software or systems
Upload any viruses, malware, or harmful code
Resell, distribute, or commercially exploit any content or service without authorization

Misuse of our platform may result in immediate termination of your access and legal action.

5. Intellectual Property

All intellectual property on this Site—including text, code, logos, graphics, and proprietary cybersecurity tools—is owned by 5 Star Sec or its licensors. You may not copy, reproduce, or reuse any part of our intellectual property without written permission.

6. Client Responsibilities

Clients are responsible for:

Providing accurate and timely information
Maintaining secure access credentials
Following cybersecurity best practices and complying with local laws

We are not responsible for losses due to client negligence or misuse of our guidance.

7. Confidentiality

Both parties agree to maintain strict confidentiality concerning all data, system access credentials, vulnerability findings, and internal communications. We will not disclose your sensitive information unless required by law or with your written consent.

8. Payment & Refunds

Pricing and billing terms will be defined in individual service agreements. Payments must be made according to invoice terms. All sales of cybersecurity services are final, except as explicitly stated in your service agreement or required by law.

9. Third-Party Tools and Integrations

Our services may integrate with third-party software (e.g., firewalls, SIEM tools). We are not liable for performance issues, outages, or data breaches caused by third-party products.

10. Disclaimers

We strive for excellence in cybersecurity, but no system can be 100% secure. We do not guarantee complete immunity from threats, breaches, or outages. Our liability is limited to the scope defined in the relevant service agreement.

11. Limitation of Liability

To the fullest extent permitted by law, 5 Star Sec shall not be liable for:

Indirect, incidental, or consequential damages
Business interruption or data loss
Client errors or third-party failures

Our total liability shall not exceed the total amount you paid to us in the 3 months prior to the incident.

12. Indemnification

You agree to indemnify and hold harmless 5 Star Sec, its team, and affiliates from any legal claims or damages arising from your use of our Services, your violation of these Terms, or any breach of data security due to your own negligence.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, USA. Any disputes will be handled in the courts located in Ocean County, NJ.

14. Modifications

We reserve the right to revise these Terms at any time. Changes take effect immediately upon posting. Your continued use of the Site after changes are made constitutes your agreement to the revised Terms.
